Why applying without help is harder than it looks

The Court applies strict standards to every Confirmation application, and its own guidance does not cover every situation. The clerks are not legally trained and are not able to help you work through problems.

Areas where people get caught out include:

  • knowing which assets to include and at what value
  • declaring certain types of gifts made before the person died
  • understanding how different types of ownership affect the estate
  • Wills made at home or by a Will writer (rather than a solicitor), which can cause problems and delays
