Your best route through Confirmation
To work out which route is right for you, it helps to know whether the person who died had a Will and the approximate value of their estate. In practice, the right route comes down to two things:
1) The estate
What the estate involves, including how assets are held, whether there are tax considerations, and any family complications
2) Your preferences as an Executor
How much of the process you want to take on, and how confident you feel about the administrative and legal detail

! Extra steps may be needed
If there is no Will, there are extra steps. You need to be appointed as Executor first, and in most cases you need a Bond of Caution (an insurance policy the Court requires before allowing an application). We prepare the applications for both as part of our service.

Why applying without help is harder than it looks
The Court applies strict standards to every Confirmation application, and its own guidance does not cover every situation. The clerks are not legally trained and are not able to help you work through problems.
Areas where people get caught out include:
- knowing which assets to include and at what value
- declaring certain types of gifts made before the person died
- understanding how different types of ownership affect the estate
- Wills made at home or by a Will writer (rather than a solicitor), which can cause problems and delays
Even if the Court accepts an application, errors or omissions can still be flagged later by HMRC.
